Browse Forums Building A New House 1 Jul 16, 2014 8:56 pm Hi all, Can anyone advise whether eaves can be built outside building envelope? Does it vary between estates/councils? In my estate MCP, it says 'covered roof element such as portico can encroach with the front setback by up to 1m'. Are eaves considered as covered roof element? The MCP is very confusing to me, the minimum front setback is said to be 4m but the building envelope shows a 5m front setback. Even my builder are confused with them. When calling the council, they said they don't advise until the land is titled, what am I supposed to do now? Eaves, awnings, HWC, air-con etc are all regarded as ancilliary structures. Mind you eaves etc aren't allowed to project outside the BE more than 450mm in those councils either. So your building is inside the envelope and the eaves are outside the envelope? Did you need to apply for council permit to do that? Yes that's right and no we didn't need to apply. Mind you our side setbacks are larger (2 metres) than most estates seem to have so there is plenty of room for the eaves to go over. All our covered roof elements, such as eaves, gutters etc need to be within the building envelope, we also have to stay 1m from each side. So all up our walls need to be 1700mm from the side with 450mm eaves plus gutters etc. Update from me! Couldn't find the trimmer - not sure if there isn't one simply because the eave is so narrow.
